Article 1 – Purpose

Next-Ticket is an online ticketing service (the “Platform”) published by Magelan Inc. (“Magelan”). The Platform enables event organisers (the “Organiser”) to offer their admission tickets (the “Tickets”) for sale on www.next-ticket.be. The person who buys a Ticket is the “Buyer”; the person who uses it is the “Participant”.

These terms apply to every order placed through the Platform. The Organiser sells its Tickets in its own name and on its own behalf: the contract of sale is concluded between the Organiser and the Buyer. Magelan provides the technical tool, issues and sends the Tickets, but never takes part in the organisation of the Event, for which the Organiser is solely responsible. The Organiser may add its own terms about the Event itself; they are shown to you on its page and in the basket.

Article 2 – Prices

Prices are shown in euros, all taxes included. When the Organiser chooses to pass the Platform's service fee on to the Buyer, that fee is shown next to the price from the price list onwards: the amount you see is the amount you pay. The Organiser may change its prices during the sales period; the applicable price is the one in force when you place your order.

Article 3 – Availability and basket

The Platform shows availability in real time. The seats in your basket are reserved for the period indicated; if you do not confirm within that period, they are put back on sale. You can check and change the content of your order before paying. If seats become unavailable between the start and the end of your order, the system tells you so.

Article 4 – Seating

Unless otherwise stated at booking and on the Ticket, seating is unallocated. Where the Organiser offers numbered seats, you choose your seat or area during the order; a plan or diagram is indicative only and has no contractual value.

Article 5 – Order and payment

Purchases are made without an account. You provide an accurate email address: this is where your Tickets are sent. Confirming your order obliges you to pay the price indicated.

Online payments are processed by Mollie B.V., a payment institution licensed in the Netherlands, using the payment methods enabled by the Organiser (Bancontact, Payconiq, credit card, etc.). Payment may require strong authentication (3-D Secure). The amount paid goes directly to the Organiser's Mollie account; Magelan never holds your money. Your bank details are not stored by the Platform. A payment that is later refused or reversed by the bank invalidates the order and the corresponding Tickets.

Free Tickets require no payment: the booking is confirmed as soon as you validate it.

Article 6 – Confirmation and delivery of Tickets

Once your order is paid, a confirmation is displayed and you receive an email containing your Tickets in PDF format and a personal link through which you can retrieve them at any time. Check that you have received them, including in your spam folder: some email providers delay delivery. If nothing arrives after a few hours, contact the Organiser, who can resend your Tickets from its management area. Non-receipt of the email does not invalidate the order.

Article 7 – Features and use of Tickets

Content. Each Ticket shows the Organiser, the Event, the date, the price category, the price paid, a unique number and a QR code.

Medium. The Ticket is presented on paper (legible and undamaged) or on the screen of a phone or tablet. The Participant is responsible for being able to present the Ticket at the entrance.

Single use. A Ticket entitles the holder to a single admission, for the venue, date and time printed on it. In the event of loss, theft or copying, only the first person to present the Ticket is admitted; a holder presenting a Ticket already used is not entitled to any refund. Keep your Ticket confidential. Reproducing, duplicating or forging a Ticket is prohibited.

Named Tickets. Where the Organiser has set a named price category, the Participant's name appears on the Ticket; it is personal and non-transferable without the Organiser's prior consent.

Article 8 – Checks at the entrance

The Organiser checks the validity of Tickets at the entrance, under its own responsibility. It is not required to verify the holder's identity, since the Ticket bears a unique and unpredictable number; for a named Ticket it may ask for an official photo ID. The Organiser may require other supporting documents announced on its page, in the confirmation email or on the Ticket. Admission may be refused for a Ticket already used, forged or obtained fraudulently, without refund.

Article 9 – No right of withdrawal, refunds

In accordance with Article VI.53, 12° of the Belgian Code of Economic Law and, for consumers residing in France, Article L221-28, 12° of the French Consumer Code, Tickets giving access to a leisure activity on a specific date or period are not subject to the right of withdrawal. Every order is firm and final. A Ticket is not refunded, even in case of loss or theft, and is neither exchanged nor taken back, unless the Organiser agrees.

Only the cancellation or a substantial change of the Event (date, venue, programme) gives rise to a refund. It is made by the Organiser, from its Mollie account, solely to the original Buyer and to the payment method used. Service fees are not refunded unless the Organiser decides otherwise. Any decision to cancel, postpone or change an Event is the Organiser's entire responsibility; Magelan cannot be required to refund a Ticket.

Article 10 – Personal data

Who processes your data. Your order data are processed by Magelan on behalf of the Organiser, which is the data controller for the organisation of its Event. Magelan also processes them on its own behalf to evidence the payment, secure the Platform and meet its legal obligations.

Data collected. The Buyer's first name, surname and email address; the Participants' names for named Tickets; the order data (Tickets, amounts, payment reference, excluding bank details, which are processed by Mollie); the IP address and language of the order.

Purposes and legal bases. Performance of the contract (processing the order, issuing and sending the Tickets, checks at the entrance, communication about the Event); compliance with legal obligations (accounting, fraud prevention); Magelan's legitimate interest in securing the Platform. The Platform sends no commercial messages without your consent.

Recipients. The Organiser of the Event; Mollie for payment; Magelan's technical providers for hosting and email delivery, all located in the European Union. Your data are never sold.

Retention. Order data are kept for as long as the statutory retention period for accounting records requires (seven years); the Participants' personal data are anonymised after the Event within the period set by the Organiser.

Your rights. You have the right to access, rectify, erase, restrict, object to and port your data. You exercise them with the Organiser or with Magelan at the address given in Article 14, and you may lodge a complaint with the Belgian Data Protection Authority (www.dataprotectionauthority.be).

Cookies. The Platform only uses strictly necessary cookies (session, basket, language, display theme) and no advertising or tracking cookies.

Article 11 – Customer service and complaints

For any question about the Event, its admission conditions or a refund, contact the Organiser, whose details appear on its sales page. For a technical question about the Platform (Ticket not received, payment), you may contact Magelan at www.magelan.be/support. In the event of a dispute with the Organiser, or if it does not reply, Magelan may contact the Organiser to seek an amicable solution. As a consumer, you may also refer the matter to the Belgian Consumer Mediation Service (www.mediationconsommateur.be) or, in France, to the consumer mediator designated by the Organiser in its own terms.

Article 12 – Liability

Magelan is responsible for the proper functioning of the Platform and for sending the Tickets to the email address provided. Magelan is not responsible for the holding of the Event, nor for its cancellation, postponement or change, nor for any incident during the Event, all of which fall solely on the Organiser. Nor is Magelan liable for the services of Mollie, of banking institutions or of your email provider. Nothing in these terms limits the rights granted to consumers by law.

Article 13 – Governing law and acceptance

These terms are governed by Belgian law, whatever the place of the Event. Failing an amicable solution, the courts of the judicial district of Hainaut have jurisdiction, without prejudice to the mandatory rules applicable to consumers, in particular those of the consumer's country of residence. By confirming an order, the Buyer declares having read and accepted these terms and any terms of the Organiser. The connection and transaction records kept by the Platform serve as evidence.
